Super-Priority Term Facilities Agreement and Fee Letter for the role of the lenders’ agent

The Extraordinary Administration of Agrokor has published today, in accordance with the announcement of the Extraordinary Administrator Fabris Peruško, documents which have also been delivered to the Commercial Court in Zagreb.

The Super-Priority Term Facilities Agreement has been published in a consolidated version. This means that the document includes all amendments executed to date. Also, the Fee Letter for the role of the lenders’ agent under the Super-Priority Term Facilities Agreement has been published. It concerns the agent, Madison Pacific Trust Limited, whose role in these arrangements is of an administrative-technical nature and is necessary to coordinate a large number of unrelated international creditors (over 40 of them) participating in the Agreement and to facilitate the procedures related to the implementation of the Agreement.

The agent’s role is also to notify the arrangement’s participants of the status of the Agreement and all changes related thereto which is an established international practice in such deals.
